The dearth of information around China RoHS is probably one reason why this column receives so many “hits” when snippets of information become available. As previously reported, the first draft China RoHS catalogue was published on 9th October 2009 with a one month consultation window. The draft would enter into force10 months after the legislation was adopted.

So where are we at now, and what products might be included in the second catalogue?

I understand that the proposals now sit with the World Trade Organisation (WTO) Technical Barrier to Trade (TBT) committee. Countries are supposed to submit proposed new legislation to the WTO for comments mainly where there are concerns that the legislation will act as a barrier to trade. Many believe this to be the case.

With no obligatory Chinese test facilities or analysis standards published as yet it is difficult to see how things can move forward in the very near future.

Sources also expect the second catalogue to continue with the consumer products theme and possibly include things like TV and VCR / DVDs.

China RoHS applies to products imported into China for sale in China and products manufactured in China and sold in China, but excludes products imported into China for re-export or manufacturing of products for export.
