    EEE returns pre & post July 2017

       

      Hello Gary.

       

       

       

      Hope all is well. Can you answer me a few questions in relation to RoHS please?

       

       

       

      Scenario 1.

       

      XYZ company sells a piece of EEE into Europe before Category 8 deadline of July 22nd 2017, hence isn’t compliant, but no problem.

       

      The piece of EEE is returned by the customer as a Warranty fail due to a motor failure before July 22nd 2017

       

      The receiving customer requires the piece of EEE back post July 22nd 2017.

       

      Does the overall piece of EEE need to be RoHS compliant because its shipped back to them post July 22nd 2017, or can is be shipped back to them as non-complaint as the piece of EEE was Put On The Market (POTM) before July 22nd 2017 and returned back to the same original customer?

       

       

       

      Scenario 2.

       

      XYZ company sells a piece of EEE into Europe before Category 8 deadline of July 22nd 2017, hence isn’t compliant, but no problem.

       

      The piece of EEE is returned as a Warranty fail due to a motor failure before July 22nd 2017

       

      The receiving customer no longer requires the piece of EEE.

       

      The motor is re-furbished and the piece of EEE is put on the shelf/storage.

       

      XYZ company receive an order from a different customer and agree to the re-furbished piece of EEE with its new motor.

       

      The piece of EEE is shipped to the new customer post July 22nd 2017

       

      Does the piece of EEE need to be RoHS compliant as its being sold to a new customer as its being sold post July 22nd 2017, even though it was POTM before July 22nd 2017 to its original customer?
